Terms of Service

Introduction

These Terms of Service ("Terms") govern your use of the Barheaven mobile application and related services ("Barheaven," "we," "us," or "our"). Barheaven is operated by an independent developer. By accessing or using Barheaven, you agree to these Terms.

Please also review our Privacy Policy, which is incorporated by reference into these Terms.

1. Eligibility

You must be at least the legal drinking age in your jurisdiction to use Barheaven. By using the service, you represent and warrant that you meet this requirement and that your use complies with applicable laws. Barheaven reserves the right to terminate accounts where eligibility cannot be confirmed.

2. Your Account

You may need to create an account to access certain features. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Ensuring the information you provide is accurate and up to date
• Not sharing your account or impersonating another person

3. User Content

You may submit content such as profile information, reviews, live chat messages, reports, vibe updates, photos, and videos ("User Content").

You retain ownership of your User Content. However, by posting User Content on Barheaven, you grant Barheaven a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, format, adapt, and otherwise process your User Content solely as necessary to operate, maintain, improve, moderate, and protect the service.

4. Content Rules

You agree not to post or share content that is:

• Unlawful or illegal
• Threatening, abusive, or harassing
• Hateful or discriminatory
• Sexually exploitative
• Violent or dangerous
• Misleading or fraudulent
• Spam or promotional abuse
• Infringing on intellectual property rights

5. Moderation

Barheaven may use automated systems and human moderation to review, restrict, or remove content and accounts that violate these Terms or create safety, abuse, fraud, or legal risks.

6. Public Areas

Content posted in venue chats, reviews, or other public features may be visible to other users. You should not post personal or sensitive information that you do not want to be publicly visible.

7. Prohibited Uses

You agree not to:

• Scrape or collect data from the platform
• Use bots or automated systems without permission
• Attempt to reverse engineer the application
• Interfere with the security or operation of the service
• Impersonate other individuals or organizations
• Misuse the platform for illegal activities

8. Third-Party Services

Barheaven relies on third-party providers for services such as hosting, authentication, maps, location services, notifications, and moderation. We are not responsible for outages, errors, or content provided by third-party services, but we remain responsible for our own compliance with applicable law.

9. Venue and App Information

Information about venues, including opening hours, popularity indicators, crowd levels, reviews, and live updates, may be incomplete, delayed, or inaccurate. Barheaven does not guarantee the accuracy, safety, legality, availability, or quality of any venue, event, or user-submitted information.

10. User Interactions

Barheaven does not conduct background checks on users and is not responsible for the behavior of users, venues, or third parties. You are solely responsible for your interactions, decisions, travel, purchases, and conduct when using the service or visiting venues.

11. Intellectual Property

The Barheaven application, including its software, design, branding, logos, and platform features, excluding User Content, are owned by Barheaven and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the service without permission.

12. Termination

We may suspend, restrict, or terminate your access to the service at any time if we believe you have violated these Terms, harmed other users, abused the platform, or exposed Barheaven to legal risk.

13. Account Deletion

You may request deletion of your account and associated personal data through the deletion tools provided in the app or by contacting us at the support email listed below. Certain data may be retained where required for legal, fraud-prevention, security, or record-keeping purposes.

14. Dispute Resolution

Before initiating any formal legal proceeding, you agree to contact Barheaven support and attempt to resolve any dispute informally. If a resolution cannot be reached within 30 days, either party may pursue the matter through the courts of the Province of Ontario, as set out below.

15. Disclaimers

Barheaven is provided "as is" and "as available." We make no warranties or guarantees regarding:

• Availability or uninterrupted operation
• Accuracy of venue or user-submitted information
• Reliability of third-party services

16. Limitation of Liability

To the maximum extent permitted by law, Barheaven and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business arising from your use of the service.

17. Indemnification

You agree to indemnify and hold harmless Barheaven and its operator from any claims, damages, losses, liabilities, and expenses arising from your use of the service, your User Content, or your violation of these Terms.

18. Privacy

Your use of Barheaven is also governed by our Privacy Policy, which describes how we collect, use, store, and share personal information in accordance with applicable privacy laws, including PIPEDA where applicable.

19. Changes to These Terms

We may update these Terms from time to time. When changes are made, the effective date will be updated. Where material changes are made, we will endeavour to provide reasonable notice to users. Continued use of the service after changes constitutes acceptance of the updated Terms.

20. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Ontario.

21. App Store Terms

If you download Barheaven through an app store, including the Apple App Store or Google Play Store, you acknowledge that the app store provider is not responsible for the application or its content and has no obligation to provide maintenance or support for the app.
